Dad jailed for baby shaking death

'This is not a case of a 45-day-old baby accidentally falling out of a baby bouncer'

A FATHER who shook his new-born son to death while his partner was at the dentist has been jailed for eight-and-a-half years.

Pedro Rubim dialled 999 and said that his two-month-old son had slip­ped out of a baby bouncer and hit his head while his back was turned at his flat in Finchley Road, Blackfriars Crown Court was told.

He said that he had then shaken the baby, Alejandro, to try to revive him after the fall. But a jury rejected his claims and found him guilty of manslaughter yesterday (Wednesday) after hearing expert evidence that the injuries could not have been caused by a fall from a low height.

His partner had gone to the dentist for a couple of hours at the time and had left Mr Rubim sitting on the settee with their son and a bottle of milk, the prosecution said. Alejandro was just 45 days old when he was admitted to hospital on the morning of February 20, 2016. He died four days later at Great Ormond Street Hospital from injuries to his brain, head and eye.

Olcay Sapanoglu, from the Crown Prosecution Service London’s Homicide Unit, said: “This is not a case of a 45-day-old baby accidentally falling out of a baby bouncer, but the death of a small child while in the sole care of his father.  Although Rubim called 999 himself, the prosecution was able to present a number of medical professionals as witnesses who were clear that Alejandro’s fatal injuries were far from consistent with a fall from a low level height.”

He added: “Many of them pointed to medical evidence that showed Alejandro’s injuries were most likely caused by being shaken and or thrown. “Deaths involving infants are particularly tragic and the CPS will always consider the evidence and circumstances surrounding each individual case before considering whether it is in the public interest to bring a prosecution.”
